Imagine First LLC (“Imagine First,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit www.imaginefirstlabs.com, create an account, place an order, contact us, or otherwise interact with our services (collectively, the “Services”).

1. Eligibility and Age Requirement

The Services are intended only for persons 21 years of age or older. We do not knowingly collect personal information from anyone under 21. If we learn that we collected such information, we will take reasonable steps to delete it.

2. Personal Information We Collect

Depending on how you interact with us, we may collect:

  • Contact and identity information: name, email address, telephone number, billing address, shipping address, and account identifiers.
  • Order and transaction information: products ordered, order value, discounts, affiliate or referral codes, fulfillment status, shipping information, returns, communications, and payment status.
  • Account information: customer-account details, login-related records, purchase history, and preferences. Shopify manages customer-account authentication; we do not receive your one-time login codes.
  • Communications: information submitted through contact forms, email, telephone, customer support, local-pickup requests, surveys, or reviews.
  • Device and usage information: IP address, browser, device type, operating system, referring URLs, pages viewed, clicks, cart activity, approximate location, timestamps, cookies, pixels, and similar technologies.
  • Age-gate information: confirmation that you meet our minimum age requirement and related technical records.
  • Payment information: payment status and limited transaction details. Payments made through Zelle or another manual payment method are handled by the applicable bank or payment service under its own privacy practices. Do not send us passwords, PINs, full bank credentials, or other sensitive authentication information.

3. Sources of Personal Information

We collect information directly from you, automatically from your browser or device, and from service providers and business partners such as Shopify, shipping carriers, analytics and advertising providers, email-service providers, affiliate-platform providers, and payment services.

4. How We Use Personal Information

We may use personal information to:

  • process, verify, fulfill, ship, and support orders;
  • provide customer accounts, purchase history, local pickup, and customer service;
  • communicate about orders, account activity, product availability, service messages, and—where permitted—marketing;
  • operate, personalize, analyze, secure, troubleshoot, and improve the Services;
  • measure advertising, referrals, discounts, and affiliate performance;
  • detect fraud, misuse, security incidents, and violations of our policies;
  • maintain business, tax, accounting, compliance, and legal records; and
  • comply with law, enforce agreements, and protect the rights and safety of Imagine First, our customers, and others.

5. Cookies, Analytics, Advertising, and Tracking

We and our service providers may use cookies, pixels, local storage, and similar technologies for essential site functions, security, analytics, attribution, personalization, and advertising. These providers may include Shopify, Google/YouTube, Klaviyo, affiliate-platform providers such as UpPromote, and our age-verification provider. Their use of information is governed by their own terms and privacy policies.

You may control cookies through your browser and, where available, our cookie-preference tools. Blocking cookies may affect site functionality. We honor legally recognized opt-out preference signals, including Global Privacy Control, where required. Because there is not a universally accepted standard for browser “Do Not Track” signals, the Site may not respond to every DNT signal. Third parties may collect information about your activity over time and across websites as described above.

6. How We Disclose Personal Information

We may disclose personal information to:

  • Shopify, which hosts the store, checkout, customer accounts, and related commerce services;
  • shipping, fulfillment, email, analytics, advertising, customer-support, age-verification, fraud-prevention, and technology providers;
  • affiliate and referral service providers to attribute qualifying orders and administer ambassador programs;
  • banks or payment services involved in a transaction;
  • professional advisers, insurers, auditors, and authorities when reasonably necessary; and
  • a buyer, successor, or other party involved in a merger, financing, reorganization, sale, or transfer of all or part of our business.

We do not sell personal information for money. Certain analytics or advertising disclosures may be considered “sharing,” “targeted advertising,” or a “sale” under some state privacy laws. Where applicable, you may opt out through available privacy controls, a recognized opt-out signal, or by contacting us.

7. Email and Marketing Choices

We may send transactional messages about orders, accounts, pickups, security, or customer service. If you separately consent to marketing, we may send promotional email or other communications through providers such as Klaviyo. You may unsubscribe using the link in a promotional message. Unsubscribing does not stop necessary transactional communications.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including order fulfillment, customer service, fraud prevention, legal compliance, dispute resolution, tax and accounting obligations, and enforcement of agreements. Retention periods vary by the type of information and applicable requirements. We may delete or de-identify information when it is no longer reasonably needed.

9. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the security of your email account and any device used to access your customer account.

10. Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have rights to request access to, correction of, or deletion of personal information; obtain a portable copy; learn about categories of information collected and disclosed; opt out of certain sale, sharing, targeted advertising, or profiling; limit certain uses of sensitive information; and appeal a denied request. You also have the right not to receive discriminatory treatment for exercising applicable privacy rights.

To submit a request, email support@imaginefirstlabs.com with “Privacy Request” in the subject line. We may need to verify your identity and authority before completing a request. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and identity verification. We will respond within the time required by applicable law.

11. California Privacy Disclosures

California residents may request information about the categories and specific pieces of personal information collected, sources, business purposes, and categories of recipients, and may request correction or deletion, subject to exceptions. If applicable, California residents may also opt out of sale or sharing and limit certain uses of sensitive personal information. We do not knowingly sell or share the personal information of anyone under 16. During the preceding 12 months, we may have collected and disclosed the categories described in Sections 2 and 6 for the business purposes described in Section 4. We do not offer financial incentives in exchange for personal information unless separately disclosed with the required terms.

12. International Processing

Our service providers may process or store information in the United States and other countries. Those locations may have data-protection laws different from those where you live. Where required, appropriate safeguards are used for international transfers.

13. Third-Party Links and Services

The Services may link to third-party websites or services. We are not responsible for their privacy, security, or content. Review their policies before providing information.

14. Changes to This Policy

We may update this Policy to reflect changes in our practices, technology, legal requirements, or Services. We will post the revised Policy with an updated date and provide additional notice when required by law.
